Term and conditions for bookings are as follow:
1 Payment
1.2
In case of payment into the bank account, a deposit of 50% is required from
the guest upon reservation. The reservation will only be confirmed once the
deposit is received. The balance is due 1 month prior to arrival unless
otherwise stated in the reservation or quotation.
1.3
The total amount is due when the guest books 30 days or less before arrival.
1.4
Kaapstad.org will provide the guest with a confirmation number if this is
given by the hotels or guesthouses.
1.5
In case of credit card payment, the guest will fill in a credit card form
which has to be returned to Kaapstad.org. This document has to be signed and
credit card details have to be provided. Once this document is received, a
deposit of 50% will be deducted. The guest will receive a confirmation in
return.
1.6
Kaapstad.org will send an invoice once a reservation request has been
confirmed by the guest.
1.7
Kaapstad.org will provide the guest with the contact details from the
accommodation or other provider and a route description to the
accommodation.
1.8
All extra costs made by the guest which are not stipulated in the
reservation are payable by the guest prior to departure.
2 Cancellation policy
In
case of cancellation the following policy will be executed:
2.1
If a cancellation is received 30 days prior to arrival, the full deposit is
forfeited.
2.2 A
10% handling fee will be charged in case of cancellation, the balance will
be returned to the guest
2.3
All cancellations are effective only on receipt of written notification
(fax, email, letter)

Quotes
3.1
Kaapstad.org will answer every quote request within 24 hours
3.2
Quotes exclude flights and airport taxes (international and domestic),
optional excursions as per program, items of a personal nature, tips for
guide and driver and drinks during included meals.
3.3
Quotes included the following services:
Accommodation including a full South African breakfast
If
applicable: meals as indicated per itinerary, transfers, excursions,
transport, a local guide in the language of the guest, portages during the
trip, entrance fees for visits mentioned in the itinerary, 14% VAT and 1%
Tourism Levy (Tomsa).

Hotels
4.1
If a hotel or guesthouse or other accommodation provider should be fully
booked (due to overbooking made by the accommodation provider), Kaapstad.org
will look for at least equivalent or superior accommodation to those of
average standard in the corresponding hotel category.
4.2
Kaapstad.org guarantees that the accommodation is in possession of all
necessary permits and licenses.
4.3
The accommodation complies with all national and international health and
safety regulations.

Transport
5.1
The transport providers guarantee that the used vehicles comply with
national and international safety regulations
6
Liability and payment of damages
6.1
If any loss or damage should result from the injury or death of a customer,
material damage to property, intangible damage resulting from loss of
enjoyment of holidays, or any commercial loss or consequentional damage to
Kaapstad.org, the guest will be fully liable with the respect to
Kaapstad.org and will hold Kaapstad.org completely harmless.
6.2
Kaapstad.org is not liable for any damage caused by guests.

Data protection measures
7.1
Kaapstad.org shall process any data relating to the customers fairly and
lawfully in accordance with applicable laws and regulations including all
applicable date protection laws. The guest shall hold Kaapstad.org and its
affiliated companies harmless against any claim in consequence of the
disclosure or transfer of such data.
7.2
Data and private information from any client given to Kaapstad.org will
remain confidential.
7.3
The medical situation (beauty treatments and other) from the guest will
remain confidential, also data exchange between Kaapstad.org and the medical
doctors providing their service.
8
Beauty treatments
8.1
Any information such as medical situation from the guest and pictures which
are needed for a quotation will remain confidential between the guest,
Kaapstad.org and the medical practitioners.
8.2 A
written and signed document must be provided by the guest in case pictures
can be used for publication.
8.3
No photo material shall be used by Kaapstad.org without permission from the
guest.
9
Force majeure and hardship
9.1
Neither party shall be liable to the other for any default due to any act of
war, industrial action, nuclear disaster, natural catastrophe, geological
and meteorological phenomena or other event beyond the reasonable control of
either party. It has been explicitly agreed that the strike or lock-out made
by contract parties employees, partners or subcontractors shall not be
considered as an event of force majeure.
9.2
In the event of force majeure, the agreement will be suspended until the
force majeure has ceased to exist. If the force majeure circumstances last
more than 30 days, either party is entitled to terminate this agreement.

Representation
10.1
If a guest requests help or assistance for whatever reason, Kaapstad.org
will do everything possible to help the guest.
11
Insurance
11.1
Guests are liable for taking a travel insurance or cancellation insurance in
the home country.
13
Change of ownership or lessee
13.1
In the event of changes in the ownership or leaseholdership of the
accommodation provider or other, the entire commitments of this agreement
will be transferred to the new owner and/or leaseholder.
13.2
In case the ownership, leaseholdership or purpose of the accommodation or
other provider is terminated, Kaapstad.org will look for an equivalent
service or superior provider.
13.3
If the provider becomes insolvent, becomes bankrupt or has bankruptcy
proceedings instituted against it, the agreement may be terminated
immediately by Kaapstad.org. In that case the guest will be informed.
14
Pasports and permits
14.1 Kaapstad.org is not liable for valid pasport or any other permits to
enter the country.
