TERMS AND CONDITIONS

The hirer agrees to the total prices,
rates, fees as set out here & overleaf.
Minimum rental period is 24 hours.
Rentals are in 24 hour increments from the date and time of checkout;
rates do not include petrol.
All vehicles are delivered with a full tank of petrol and the hirer pays
for refueling upon return;
Extensions of rentals are permitted at the discretion of the rentor,
provided that notification takes place at least 24 hours in advance;
The hirer is liable for all fines and penalties incurred during the
rental period and will be charged to the hirer’s nominated credit card;
Call out for lost keys are subject to an R250.00 fee during office hours
and R300.00 outside of office hours, if within city limit. Outside of
city limits an extra fee of R3.50 per km will apply from depot to
vehicle to depot;
The hirer undertakes and agrees that if and when the vehicle is returned
to the company and it is necessary to effect repairs thereto, the rentor
will forthwith cause the repairs to be effected subject to any claims
that it might have against the hirer for the cost thereof;
The hirer agrees to pay on demand all charges resulting from the rental
of the vehicle and understands that all charges are not final and are
subject to audit and recalculation. Furthermore, the hirer is liable
for all collection costs, including attorney’s charges incurred during
the period of hire as a result of accident or negligence.
The hirer understands that in no event
will the rentor be deemed to be your agent, servant or employee
whatsoever;
The hirer agrees that on delivery the vehicle was not damaged in any way
and will accept responsibility for full payment for any damage caused
howsoever on return of the vehicle;
All rentals begin and terminate in Century City. No vehicle is
permitted beyond the borders of the Republic of South Africa. Should
you wish to travel more than 250kms out of Cape Town, rentor must be
notified in advance;
If at any time the vehicle becomes or is suspected of being unroadworthy
the hirer must cease driving and inform the rentor;
The vehicle is not permitted to be driven on untarred road surfaces.
Strictly no beach/sand usage;
The hirer indemnifies the rentor against any claims whatsoever against
the rentor, which arise during the period of hire;
All drivers must produce their driver’s license at the commencement of
the rental; such licenses must be valid and unendorsed;
The hirer must be 25 years of age or older;
The rentor shall not be held liable for any damages arising out of any
defect in or mechanical failure of the vehicle nor for any loss or
damage to any property transported or left in the vehicle, nor for any
indirect damages, consequential loss of profits or special damage of any
kind for any breach of this agreement;
The insurance excess overleaf will
apply in the event of damage, theft, losses or costs suffered by the
rentor however caused;
The terms/conditions and excess of this document overrides those of the
insurance policy conditions at the rentor’s discretion.
Insurance cover is subject to the
insurance policy conditions applicable on the vehicle and a copy is
available on request. Any damages/loss suffered by the rentor due to
non-compliance with the insurance policy conditions referred to above
will result in the hirer being personally liable;
The vehicle shall not be driven by any other person other than the
driver(s) stipulated on the rental agreement and is so no insurance
cover will be deemed to be in place and the full costs of any damages or
liabilities suffered by the rentor will be paid for by the hirer;
The vehicle will not be driven by any person who has consumed any
alcohol or taken drugs having a narcotic affect. Should this happen the
hirer will be personally liable for all damages however caused.
The rentor provides no insurance for injury cover for any persons
howsoever arising and the hirer indemnifies the rentor against any
claims made against him, which will result in the hirer being personally
liable;
In the event of acceptance of a claim by the
insurer for damage or theft of the vehicle, the hirer agrees to be
solely liable for the excess as specified on the front of the agreement
or 10% if the claim is over R100 000.00;
Personal belongings are not covered by any insurance supplied by the
rentor;
In the event of loss or damage to the vehicle the hirer shall a) obtain
the name and address of everyone involved and of possible witnesses b)
not admit to any responsibility or release any party from liability or
potential liability or settle any claim or potential claim against or by
any party accept any disclaimer of liability c) notify the police and
the rentor as soon as possible and within 24 hours of the occurrence d)
within 48 hours of the occurrence shall complete and furnish the rentor
the whereabouts and accident details of the vehicle e) shall make
adequate provisions for the safety and security of the vehicle f)
warrant that the insurance claim form will be completed true and correct
in every aspect.
I have read, understood and accept the
terms and conditions of this rental agreement and particularly
acknowledge that I am personally liable as the hirer under this
agreement. I confirm that my signature below shall constitute authority
to debit my nominated credit or charge card with the total amount due.
I hereby authorize Short Shift Rentals to debit my credit or charge card
account for the amount reflected above in respect of the insurance
excess. I understand that this amount is refundable as per the terms
and conditions on the reverse of this rental agreement. I confirm that
I will be liable for any damages caused to the vehicle while in my
possession.
